1. Bookings

The making of a booking does not constitute the creation of a contract and British Action Academy Limited reserves the right to decline a booking for any reason whatsoever. If a booking cannot be fulfilled for any reason, British Action Academy Limited will promptly refund all monies. The making of a booking constitutes your acceptance of the British Action Academy Limited’s Terms & Conditions of trading. For the protection of our customers, British Action Academy Limited reserves the right to undertake additional security checks and if necessary, delay the booking. All bookings must be made via the British Action Academy, we have no affiliation with any third parties.

Please note, when booking a course you have the option to use Klarna or Paypal. These services exist outside the British Action Academy and so you will be held to the terms and conditions of these respective platforms, along with our own booking terms.

2. VAT

Prices quoted include VAT at rates applicable on the day of purchase.

3. Booking Form

British Action Academy Limited provides an online booking form for all Training Courses, which must be completed in order to book a place on a Training Course. A booking is not complete until a form has been submitted and payment has been taken.

4. Instalments

We offer instalment plans which are spread over 3 separate payments. This allows payments to be made over a certain amount of time, as opposed to a one-off payment. If you choose the instalment plan, the cost of the course is £20.00 more than purchasing the course as a one-off payment. The extra £20.00 is an administration charge for the arranging and processing of the instalment plans.

First payment

The first payment is a non-refundable deposit to hold your place and is due immediately. Should you cancel for any reason, the initial deposit will be retained under all circumstances.

Second and final payments

Once you have paid the initial deposit, we will send you an email with dates of when the next payment instalments are due to be made. On each of those dates we will send you a new invoice via email, which you will need to pay within 48 hours. If you don’t receive these emails, it is your responsibility to follow this up with the office in order to receive the correct email.

If you would like the instalment option within 28 days before the start of the course, we will only be able to offer you a 2-step instalment plan. The first is the non-refundable deposit and the last instalment will need to be the final balance. The final balance is due no less than 10 working days prior to the course start date.

Late payments

We provide 3 working days grace for any late instalment payments. During this time we shall send two reminders via email. Should we not receive communication from you at this time and no payment is received, we reserve the right to cancel your booking and retain all monies paid.

We want to ensure that you are able to attend the course, so please make prompt payment. If you are away or have any problems meeting your agreed payment date, please contact us as soon as possible to avoid these cancellation charges.

Should we have to chase you for instalment payments on a regular basis, the BAA reserves the right to refuse the instalment plan option on future bookings and will require the full balance up-front.

5. Cancellations - Full Payment Plan

Applicable to all training courses:

If you have paid the full amount up-front, you are eligible to cancel your place at any time up to 10 working days prior to the training course start date. You also have the option to roll your payment over to the next available course, or apply for a refund (minus a £20 administration fee). During normal business operations, please allow 7 working days for a refund to be processed.

You may only roll over your booking fee once. Should you wish to roll your payment over to the next course and there is an increase in the price of the course within the time period between purchasing the course and attending, you will be required to pay the updated (current) price, 10 working days before the start of the course.

Should you cancel within 10 working days before the training course start date, you will be subject to a 100% cancellation fee. On certain occasions we may be able to fill your space. If this is possible, we may offer you a refund (minus £20 administrative fee). However, this is not a guarantee. 

Should you need to cancel due to injury/illness within 10 working days prior to the start of the course, you may be subject to a 100% cancellation charge. If you cancel outside the 10 working day period due to injury/illness or you are unable to complete part of an attended course due to an injury or illness, a copy of a valid and dated doctor’s certificate is required (to be provided within 7 working days from the first day of the course) in order to gain a refund (minus a £20 administration fee). If you have paid for the course in instalments, your first instalment is non-refundable.

Should we not receive the certificate within the stated period, we reserve the right to retain all monies paid. 

British Action Academy Limited cannot be held liable for any travel/accommodation expenses incurred in this instance.

A refund can only be made to the purchaser.

If payment was originally made by credit/debit card, the refund will be made back to the same card.

If you are using Klarna or Paypal and wish to cancel, you will be held to the terms and conditions of these services as well as those of the British Action Academy.

6. Cancellations - Instalment Plan and Other Payment Methods

Should you wish to cancel your space on the course at any time before 10 working days before the start of the course and you have paid by our instalment plan, the first payment is non-refundable under all circumstances. We will refund any further instalment payment plans to you as soon as possible. During normal business operations, please allow 7 working days for your refunds to be processed.

Should you cancel within the 10 working days before the start of the course, you will be subject to 100% cancellation charge of the full payment amount.

Dependent on individual circumstances, the cancellation charge may be lowered. This is at the British Action Academy's discretion.

7. Cancellations: Consumers’ Statutory Right to Cancel

Accrual of the Statutory Right to Cancel the Contract

Should you book a training course for a purpose that is wholly or mainly outside of your trade, business, craft or profession, you are entitled to a 14-day “cooling off” period. This begins the day after the day on which you enter into the contract for the supply of the training course with British Action Academy Limited.

During the 14-day “cooling off” period, you have the right to cancel the contract without giving any reason and at no cost to you.

Exercise of the Statutory Right to Cancel the Contract

In order to exercise your right to cancel the contract, you must inform British Action Academy Limited of your decision to do so. Should you exercise this right to cancel, British Action Academy Limited will refund any and all payments that you have made pursuant to the cancelled contract, by the end of 14 days after the day on which communication is made of your decision to exercise your right to cancel the contract.

Booking a Course Due to Start Within the Statutory “Cooling Off” Period

Should you book a training course due to begin during your 14-day “cooling off” period, that period shall expire either at the end of the 14-day “cooling off” period or at the end of the training course, whichever occurs first.

Should you exercise your right to cancel the contract during the training course, you will be liable to a full cancellation charge (100% of the cost). This sum will be off-set against any payments that you have already made to British Action Academy Limited pursuant to the cancelled contract.

Interaction of the Statutory Right to Cancel for Consumers with the British Action Academy’s Cancellation Policy

Should you be entitled to a 14-day “cooling off” period, during that 14-day “cooling off” period the provisions within Part 4 of these Terms and Conditions of trading, entitled “Cancellations” do not apply. The provisions contained within Part 4 of these Terms and Conditions of trading apply as normal after the expiry of the “cooling off” period.

If you are using Klarna or Paypal and wish to cancel, you will be held to the terms and conditions of these services as well as our own.

8. Payment Roll-Over

Should you cancel a training course outside of the 30 day cancellation period, the British Action Academy Limited will offer you the chance to roll your booking over to the next available course and keep hold of your original payment. 

British Action Academy Limited will only offer the chance to roll-over a booking once. A roll-over cannot be changed to a refund after it has been agreed.

If you are unable to attend a course and a roll-over has been granted, this payment will be moved to the next available course date. If this does not happen and we have received no communication from yourself, we reserve the right to retain the full payment of any monies held after a 6-month period from the date of the cancellation. If for any reason, the next available course should not be held, the funds will be moved onto the following available course. If you are unable to attend the roll-over dates, please contact the British Action Academy office to discuss this further.

Payments will only be held for a 6-month period, after this time it will be retained if we do not receive communication in writing via email.

9. Refunds

Should you cancel a Training Course within the agreed cancellation time and do not wish to roll your booking over, British Action Academy Limited will refund the course fee (minus a £20 administration fee).

A refund can only be made to the purchaser.

If payment was originally made by credit/debit card, the refund will be made back to the same card.

If payment was made by BACS, the refund will be paid back in the same manner to the purchaser’s account.

Refunds are dependent on the above terms and conditions and where it falls wthin the cancellation period.

If you are using Klarna or Paypal and wish to cancel, you will be held to the terms and conditions of these services as well as our own.

10. DBS Certificate - Gun Rush

As a condition of booking on to our Gun Rush training experience, we require a valid Basic DBS Certificate for added security, as the course teaches live firing and weapon handling. If you make payment for Gun Rush and you cannot provide a copy of a valid DBS Certificate in time for the course, we reserve the right to cancel your booking and retain any monies paid.

You must apply for the DBS Certificate yourself and can view more information on how to do this this here;

You must email a scanned copy of your DBS Certificate to our office at; info@britishactionacademy.com before the start of the course. The latest we will accept DBS Certificates is 2 working days prior to the start of the course.

DBS Certificates received after this time or on the day of the course will not be accepted, as we have to process them onto our system before the course starts. 

Should any convictions, past or present show up on your DBS Certificate, the BAA reserves the right to refuse entry onto the Gun Rush course. In this instance, should payment have been made, a refund will be processed under the terms of our refund policy.

11. Group Course/Event Booking

Should you wish to pay for a range of courses up-front, you have 18 months from date of purchase to attend all courses, after this time you may be liable to pay any course price increases that should occur during this period.

12. No Show

Any participant who does not show for a course/event or cancels on the morning of the event date, will be subject to a 100% cancellation fee of the cost of the booking.

British Action Academy Limited accepts a degree of extenuating circumstances. In these instances it is at the British Action Academy Limited’s discretion to provide a refund or roll the booking over to a future course date.

13. Non-Completion of a Training Course/Event

Should you not complete a course/event in its entirety for reasons not limited to injury/illness/expectation/personal dislike, you will not be entitled to a refund of the full amount or any partial amount of monies paid.

14. Training Course Physicality & Restrictions

All British Action Academy Training Courses involve medium to high levels of physicality and are therefore subject to restrictions. These include (but are not limited to) age (minimum 18 years or 16 with parental/guardian consent) and physical and medical considerations.

We measure appropriate fitness by stating that if you can successfully complete a circuit-training class without your health and wellness being compromised, the physicality of our courses should be appropriate for you. It is the purchaser’s responsibility to ensure that the training course is appropriate for them and to ensure that the restrictions are not prohibitive. We are very clear about the activities of each course listed on our website, however, if you are unsure of the suitability/physicality of the course/event or have any questions please contact us on 01252 711130 or info@britishactionacademy.com and we will be happy to advise.

15. Injuries/illness

It is important to be in good physical shape with no injuries or illnesses which may hinder your participation on a course/event. If an instructor becomes aware of any injuries or illnesses not previously disclosed on the booking form, that are noticeably affecting your performance, they will be at liberty to assess your physical condition and decide whether you should continue with all/part of the course.

16. Data Protection

British Action Academy Limited maintains strict security measures in order to protect any personal information. This includes following certain procedures, e.g.; encrypting data on our websites in order to ensure compliance with all applicable legal requirements.

We do not sell or disclose your personal information to other companies without your prior consent. We do not sell mailing lists to third parties. British Action Academy Limited is fully PCI Compliant.

17. Training Course Descriptions, Formats and Durations

Details of training course descriptions, formats and timings given on our website and in any other literature are intended only to present a general idea of the training courses available and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and British Action Academy Limited.

As British Action Academy Limited offers a number of training courses, details such as session lengths, itineraries, equipment used and numbers of participants may vary.

18. Discount Codes & Entitlements

British Action Academy Limited reserves the right to exclude any Training Course from discount schemes. Only one discount code may be used per order. Discounts apply to new orders only and cannot be used against exchanges, extensions, money on account, delivery and fulfilment charges or any other facility provided by British Action Academy Limited. You may be required to provide evidence of your entitlement to any discount.

19. Third Parties and Re-sale

A person who is not recorded as the training course/event attendee with British Action Academy Limited has no right under the Contracts (Rights of Third Parties Act 1999) to enforce any terms and conditions of booking.

A training course which has been re-sold by any method (internet auction sites) without our prior consent will be invalid and British Action Academy Limited will not be under any obligation to provide a service.

20. Course Programme

British Action Academy Limited reserves the right to alter or change the programme of a course without prior notification and without refund of monies or exchange.

21. Copyright

All course content is fully copyrighted to British Action Academy Limited. All course names and branding is trademarked to British Action Academy Limited. On undertaking a course with the British Action Academy you agree not to copy/replicate any part of the course including but not limited to; course content from presentations, course design/structure, instructor demonstration videos, course names, branding etc. for commercial purposes.

 

British Action Academy Limited takes the protection of its training content and branding extremely seriously and should a breach of copyright be noticed, British Action Academy Limited reserves the right to seek legal action against the individual/company.

If the individual is a current student, British Action Academy Limited reserves the right to remove them from any training course with immediate effect.

22. Prices & Location

All locations and prices are correct at the time of going to press, but may change or be withdrawn for reasons beyond our control. Any change of location for reasons beyond British Action Academy Limited’s control will be communicated to the participants as soon as possible and will not be subject to any refund, unless the event cannot go ahead. In most circumstances, a roll-over option will be offered.

23. Force Majeure

By booking a training course/event with British Action Academy Limited you acknowledge that our courses are dependent on certain factors beyond the control of British Action Academy Limited and agree that we are not liable for the cancellation, postponement or alteration of any training course for reasons beyond our reasonable control (including but not limited to) extreme weather, unauthorised access, theft, severe weather, earthquakes or natural disasters, strikes, or other labour problems, wars or governmental restrictions, terrorist actions, mechanical failure, location changes or otherwise.

If these situations should occur, all reasonable efforts will be made to reschedule the course/event at the convenience of everyone involved. Please note that training courses and other products/services are subject to change without notice. This does not affect your statutory rights.

24. Cancellation By Provider

If a training course is cancelled by British Action Academy Limited either before or on the day of the event, due to circumstances beyond all reasonable control, British Action Academy Limited will arrange to re-book the participant at a mutually agreed time and date at no extra cost.

British Action Academy Limited cannot be held liable for any costs including (but not limited to) travel or accommodation expenses incurred in this instance.

25. Liability

All British Action Academy training courses involve high-risk activities and will require the signing of a Liability & Waiver Agreement on arrival to the training course.

26. Admittance Rules

If the British Action Academy Limited’s instructors deem any participant unsuitable for the training course for reasons including (but not limited to) physical injury not mentioned prior to booking, being under the influence of alcohol/drugs and repeated disregard to safety instructions, British Action Academy Limited reserves the right to refuse admittance or to remove the participant from the training course.

Refunds in this instance are discretionary and the British Action Academy cannot be held liable for any costs including (but not limited to) travel or accommodation expenses incurred in this instance.

We unfortunately cannot allow any spectators in the training area.

27. Availability

Training courses are subject to availability and in some cases, may be subject to weather conditions. To avoid disappointment we recommend that customers book well in advance. During peak periods it may be necessary to allow a longer notice period, although we might be able to occasionally fit in a booking at short notice.

We strongly advise that you do not make any travel, accommodation or other arrangements until you have received confirmation of your booking and training course date.

The details listed above are the terms and conditions applied to British Action Academy Limited. Your statutory rights are not affected.
